1. Subject of the warranty
1.1 MERME GmbH (“MERME”) grants the end consumer a voluntary money-back guarantee (“Guarantee”) for the purchase of the product “Oxygen Water”. 1.2 This guarantee applies in addition to the statutory warranty rights. These remain unaffected by the guarantee and continue to exist independently of it.
2. Warranty period
2.1 The warranty can be claimed within 30 (thirty) calendar days from the day of receipt of the goods. 2.2 The date of receipt of the complete documents according to point 4 by MERME is decisive for compliance with the deadline.
3. Conditions of the guarantee
3.1 To claim under the warranty, the participant must prove that they have used the product in accordance with the instructions for use and in a proper manner. 3.2 Proper use shall only be deemed to have occurred if the participant:
- a Before photo created before the application started,
- takes weekly photos throughout the entire application period (at least one photo per week),
- at least one video created that documents the application of the product according to the instructions for use.
- 3.3 Incomplete, illegible or otherwise unverifiable evidence will lead to exclusion from the warranty.
4. Making a warranty claim
4.1 To make a warranty claim, the participant must send all the required documentation as per section 3 and the respective order number by email to [email address] within the warranty period as per section 2. service@merme.de to transmit. 4.2 MERME is entitled to check the evidence for completeness and plausibility. MERME may refuse reimbursement if the requirements according to section 3 are not unequivocally met.
5. Scope of reimbursement
5.1 If the product is used correctly, the purchase price paid by the participant for the product “Oxygen Water” will be fully refunded. 5.2 Refunds will only be issued to the payment method used by the participant for the original order. 5.3 Shipping costs and any additional fees (e.g. express surcharges, customs duties) will not be refunded.
6. Eligibility
6.1 Only end consumers residing in Germany are eligible to participate. 6.2 The warranty can only be claimed once per customer and product. 6.3 Participation on behalf of third parties or by submitting inaccurate information is not permitted.
7. Other provisions
7.1 MERME reserves the right to amend these terms and conditions of participation at any time or to terminate the warranty promotion for good cause. Any amendment or termination will not affect warranty claims already submitted. 7.2 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. 7.3 Should any provision of these terms and conditions of participation be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
