With the help of MERME product testers, MERME GmbH (“MERME”) uses the opportunity to incorporate consumer opinions into decision-making (e.g. product development, communication, etc.).
MERME uses communication channels for this purpose, such as:
- E-mail address
- SMS
- phone
- personal conversations (e.g. accompanied shopping, (group) meetings)
- Using the video conferencing tools “Microsoft Teams” or “Zoom”
Should communication channels other than those mentioned above be used, participants will be informed beforehand and their consent obtained. Direct contact by a participant with MERME product testers via a specific communication channel will be considered equivalent to consent.
Examples of content for MERME product testers:
- Inquiries about new product ideas/ communication ideas/ personal opinions on various topics (e.g., "What do you think of this new lipstick?", "How do you like this advertisement?", "What are the top topics on the school playground right now?", etc.)
- Accompanied shopping trips (example procedure: a MERME employee goes with a participant to dm, for example, the participant explains how they go about shopping/finding inspiration in the store)
- Personal meetings with several participants for exchange (e.g. at MERME, in a café, in a joint workshop, etc.)
- Conducting product tests (this also includes products that are still in the development phase)
If content is to be recorded, the participants will be informed in advance and their verbal consent will be obtained before the recording begins.
Participants may be asked to submit their input in writing or orally (e.g., text message, voice message), via photo or video.
In order to participate as a MERME product tester, we need the following information for each participant's profile:
- First and Last Name
- Year of birth
- Email address (for communication and, if applicable, use of video conferencing tools)
- Address (for shipping products)
- Mobile number
- If necessary, bank details may be requested for the purpose of payment of a fee.
However, in order for MERME to process the data obtained from the information, it is necessary that the participants give their consent in advance.
For all content submitted by participants to MERME, the participants guarantee the following:
- The participant is the sole author and owner of the copyrights to the content;
- All content published by participants is true.
- Participants must be at least 18 years old.
- The use of content provided by participants does not violate these terms and conditions and does not harm any natural or legal person.
Furthermore, participants agree not to transmit any content to MERME:
- the participant is known to be false, inaccurate or misleading;
- infringe a copyright, patent, trademark, trade secret, or personal rights or data protection rights of a third party;
- which violate a law, regulation or provision (including, but not limited to, provisions relating to consumer protection, unfair competition, equality and misleading advertising);
- which are or have a defamatory, libelous, inciting hatred, discriminatory, threatening or harassing effect on an individual, partnership or company on the grounds of religion or ethnic origin;
- The participant has received a payment or other consideration from an unauthorized third party;
- that contain a computer virus, worms, or other potentially harmful computer programs or files.
Violations of the above conditions may be prosecuted by MERME in accordance with the applicable legal regulations.
For all content submitted by participants, participants grant MERME a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, completely delete, adapt, publish, translate, create derivative works of, and/or sell and/or distribute such content and/or incorporate such content into any form, media or technology worldwide and without any compensation to participants.
All content submitted by participants will be used at MERME's sole discretion. MERME reserves the right to modify, shorten, delete, or not publish any content on the MERME website that, in MERME's sole discretion, violates the guidelines or other provisions of these Terms of Use. MERME does not guarantee that participants will be given the opportunity to edit or delete content they submit. Participants acknowledge that they, and not MERME, are responsible for the content of their submissions. No content submitted by participants is subject to any confidentiality obligation on the part of MERME, its agents, subsidiaries, partners, or third-party service providers, and their directors, officers, and employees.
